1. Accepting these terms
Munchii is operated by David Markusse and Niels Koeman, individuals based in the Netherlands. You agree to these terms during account creation. If you don't agree, don't create an account. Our Privacy Policy and Recipe & Safety Guidelines form part of this agreement.
Users and authorities can contact us under the EU Digital Services Act at support@munchii.app. The service and these legal pages are in English. You can contact us in English or Dutch.
2. Who can use Munchii
You must be 16 or older to use Munchii. You must not be barred from using the app under the laws that apply to you. Munchii is available in the App Store in the countries of the European Union.
3. Your account
You're responsible for your account and for keeping your sign-in method secure. Give us accurate information, don't impersonate anyone, don't share your account, and don't create accounts to get around a suspension. Tell us promptly at support@munchii.app if you think someone else has access.
4. Your recipes and posts
You keep ownership of the recipes, photos, text and recordings you add to Munchii. By posting them publicly, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, to resize an image or create a thumbnail), publish and display them only as needed to operate Munchii, including making recipes available for other users to save and cook. This licence does not give us permission to use your dish photos in marketing. It ends when you delete the material, subject to the retention described in our Privacy Policy.
Saved recipes are references to the original, rather than independent copies. If you delete the original or it becomes inaccessible, other users cannot open it through their saved reference.
We use your dish photos in Munchii marketing (website, social media, App Store) only with your opt-in permission. You can withdraw it at any time by emailing support@munchii.app; we then stop new use within 30 days.
You confirm that you have the rights to everything you post — including photos you took and recipes you wrote or adapted — and that posting it doesn't infringe anyone else's rights.
5. Acceptable use
Munchii has zero tolerance for objectionable content and abusive users. We remove such content and may ban the account that posted it, normally within 24 hours of a report.
Don't use Munchii to post or do anything that:
- is unlawful, hateful, harassing, violent, sexually explicit or exploitative;
- infringes someone's copyright, trademark or privacy — including copying a recipe's written text or photos from a book, blog or another app without permission;
- is spam, a scam, misleading, or purely promotional;
- sends unwanted, abusive or sexual direct messages;
- falsely presents an account representing a business or brand as an ordinary user;
- gives dangerous food-safety advice, or presents something inedible or harmful as food;
- attempts to scrape, reverse-engineer, overload or break the app or its APIs;
- circumvents moderation, rate limits or access controls.
Our Recipe & Safety Guidelines explain the posting rules in more detail.
We close the accounts of users who repeatedly infringe other people's copyright, as described in our Recipe & Safety Guidelines.
6. Other people's recipes
Recipes on Munchii are created by users, including the team-run accounts described below. We don't verify their accuracy. Ingredient lists, timings, allergen information and nutritional claims may be wrong or incomplete. Use your own judgement, especially where allergies, pregnancy, medical conditions or raw ingredients are involved.
7. AI features
Scanning a photo and recording your voice involve OpenAI to produce a draft recipe. These features are assistive: output can be inaccurate or incomplete, which is why we always show you the result for review before it's saved. You're responsible for the accuracy of anything you publish, and for having the right to scan or record the source material in the first place. See the Privacy Policy for how the underlying data is handled.
Imported recipe screenshots are intended for personal use. Before publishing an imported recipe, write the method in your own words, name your source and use your own dish photo. Do not use the source screenshot as the published cover photo.
8. How we moderate
We use automated tools, including OpenAI, to detect potentially prohibited public recipes, photos, comments, usernames and bios. Users and non-users can report problems. A person reviews reports, appeals and every account ban. We review reports within 24 hours, seven days per week.
We may remove material, reduce its visibility, issue warnings, suspend an account or ban it. We explain the action and applicable rule, whether automated tools were involved, and how to appeal. You can report illegal material, including copyright infringement, at support@munchii.app without an account; see what to include.
You can appeal a moderation decision within six months by replying to our message or emailing support@munchii.app. A different person reviews the appeal. Copyright removals also have a specific seven-day counter-notice step; this does not replace the six-month general appeal period.
9. Munchii Cooks
Some accounts are run by the Munchii team to share recipes. They carry a Munchii Cook badge.
10. Our intellectual property
The Munchii name, logo, app, design and software are ours and are protected by intellectual property law. These terms don't give you any right to use our branding except to refer to the app fairly and accurately.
11. Price and availability
Munchii is currently free to download and use. We may introduce paid features in future; if we do, we'll make the terms clear before you're charged and won't start charging for something you already have without telling you first. We may change, suspend or discontinue features, and we don't guarantee uninterrupted availability.
12. Suspension and ending your account
You can delete your account at any time in the app, which removes your recipes and posts as described in the Privacy Policy. We may suspend or terminate your account if you breach these terms or the Recipe & Safety Guidelines, or where we're required to by law. We give reasons for content and account restrictions as described in How we moderate. For serious threats, illegal material and child-safety issues, action may be immediate and notification may follow. If we believe someone's life or safety is at risk, we may inform the police.
13. Disclaimers
Munchii is provided "as is". To the extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits your mandatory consumer rights under the law of your country of residence.
14. Liability
To the extent permitted by law, we're not liable for indirect or consequential loss, loss of data, or loss of profits arising from your use of Munchii. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 50. We don't exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't lawfully be excluded.
Munchii is free. That is the reason for these limits.
15. Law and disputes
These terms are governed by Dutch law, and disputes will be heard by the competent courts of the Netherlands — except that if you're a consumer, you keep the protection of the mandatory law of your country of residence and may bring proceedings there.
If you downloaded Munchii from the App Store, Apple's Standard End User License Agreement also applies. Apple is not a party to these terms, is not responsible for Munchii or its content, and has no obligation to provide support.
16. Changes
We may update these terms. For material changes we notify you in the app at least 14 days before they take effect. If you don't agree, you can delete your account before then. Continuing to use Munchii after that means you accept the new version.
